1. Acceptance of Terms
By downloading, accessing, or using the Homii Helps Platform (the website https://homiihelps.in and associated apps), you agree to comply with and be bound by these Terms & Conditions ("Terms"). If you do not agree with these Terms, you must immediately cease using the Platform.
2. Role of the Platform
- Technology Intermediary: Homii Helps operates strictly as a technology platform that facilitates connections between users ("Customers") and independent third-party service providers ("Service Professionals") offering various home, repair, and lifestyle services ("Pro Services").
- Independent Contractors: Service Professionals are independent contractors, not employees, agents, or joint venturers of Homii Helps. We do not provide the Pro Services directly and accept no liability for the exact execution of the services.
3. User Accounts and Eligibility
- Eligibility: You must be at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872.
- Account Security: You must provide accurate registration details. You are solely responsible for safeguarding your login credentials and for all actions taken under your account.
4. User Conduct and Obligations
- Provide a safe, non-hazardous, and non-discriminatory working environment for the Service Professional at your premises.
- Refrain from any verbal or physical abuse, harassment, or inappropriate behavior toward Service Professionals.
- Non-Circumvention: You shall not solicit, engage, or hire any Service Professional you met through Homii Helps for services outside the Platform. Violating this clause may result in immediate account termination and legal action.
- Not use the Platform for any fraudulent, unlawful, or unauthorized purposes.
5. Bookings, Payments, and Taxes
- Pricing: The cost of Pro Services, along with any applicable platform/convenience fees and taxes (e.g., GST), will be displayed prior to confirming a booking. Homii Helps reserves the right to modify pricing dynamically based on demand, location, and service complexity.
- Payments: Payments must be made through the authorized payment gateways on the Platform or via permitted offline methods (if enabled).
- Disputes: Any payment disputes must be raised with Homii Helps customer support within 24 hours of service completion.
6. Cancellations and Rescheduling
- Customer Cancellations: You may cancel or reschedule a booking. However, cancellations made close to the scheduled service time may incur a cancellation fee to compensate the Service Professional for their time and travel.
- Platform Cancellations: Homii Helps reserves the right to cancel any booking due to the unavailability of Service Professionals, suspected fraud, or force majeure events. In such cases, full refunds of prepaid amounts will be initiated.
7. Intellectual Property
- Intellectual Property: All content on the Platform, including text, graphics, logos, software, and trademarks, is the exclusive property of Homii Helps or its licensors. You may not copy, reproduce, or distribute any part of the Platform without our prior written consent.
8. Disclaimers of Warranty
- The Platform and all its contents are provided on an "as is" and "as available" basis. Homii Helps disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access to the Platform or that the Pro Services will completely meet your expectations.
9. Limitation of Liability
- To the fullest extent permitted by law, Homii Helps, its directors, employees, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages (including property damage, loss of data, or personal injury) arising out of or related to your use of the Platform or the Pro Services provided by the Service Professionals. Our maximum aggregate liability shall be limited to the total fee paid by you for the specific disputed service.
10. Indemnification
- You agree to indemnify, defend, and hold harmless Homii Helps from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising out of your breach of these Terms, violation of any law, or any harm caused by you to a Service Professional.
11. Modification of Terms
- Homii Helps reserves the right to update or modify these Terms at any time without prior notice. The updated Terms will be published on the Platform. Your continued use of the Platform constitutes acceptance of the modified Terms.
12. Governing Law and Dispute Resolution
- Jurisdiction: These Terms are governed by the laws of India.
